## Privacy Policy

Universal Policy Governing All Data Collection and Processing

Effective date: August 4, 2026

### 1. INTRODUCTION

Daypart, Inc. ("Daypart," "we," "us," or "our") operates an intelligence and due diligence platform. This Privacy Policy describes how we collect, use, disclose, and protect information in connection with all Daypart products, services, websites, and applications (collectively, "Daypart Products"). This Privacy Policy applies to all users, visitors, and any individuals whose information we process.

By accessing or using any Daypart Product, you acknowledge that you have read and understood this Privacy Policy. This Privacy Policy is incorporated into and subject to our Terms of Service.

Daypart is an intelligence and analytics platform. We do not sell personal data about individual persons to third parties. Our business model is based on producing analytical intelligence products, not on the sale or licensing of raw personal data.

### 2. INFORMATION WE COLLECT

#### 2.1 Account Information

When you register for an account, we collect information you provide directly, including your name, email address, organization name, billing information, and any other information you choose to provide.

#### 2.2 User-Submitted Data

When you use Daypart Products, you may submit data including brand information, domain names, product identifiers, claims, assertions, evidence, and other materials ("User Data"). As described in our Terms of Service, you grant Daypart a license to use this data for the purposes outlined in Section 4 below.

#### 2.3 Automatically Collected Information

We automatically collect certain information when you access or use any Daypart Product, including:

(a) Device and browser information, including device type, operating system, browser type and version, device identifiers, and screen resolution;

(b) Usage data, including pages visited, features used, actions taken, timestamps, session duration, and interaction patterns;

(c) Network information, including IP address, approximate geographic location (derived from IP), and referring URL;

(d) Log data, including access times, error logs, and API usage records.

#### 2.4 Cookies and Tracking Technologies

We use cookies, pixel tags, web beacons, and similar tracking technologies to collect information about your interactions with our Products. These technologies include:

Analytics Technologies: We use Google Analytics, Google Tag Manager, and similar analytics services to understand how users interact with our Products. These services may collect information about your use of our Products and combine it with information collected across other websites and services.

Advertising and Marketing Technologies: We use tracking pixels and conversion tracking from the following advertising platforms, and may add additional platforms in the future:

- Meta (Facebook/Instagram) Pixel and Conversions API

- Google Ads conversion tracking and remarketing tags

- X.com (formerly Twitter) Pixel

- LinkedIn (Microsoft) Insight Tag

- Additional advertising, attribution, and analytics platforms as we may implement from time to time

These technologies may collect information about your activity on our Products and across other websites and services, and may be used to deliver targeted advertising, measure advertising effectiveness, and build audience segments. The information collected by these third-party technologies is subject to the privacy policies of the respective third-party providers.

#### 2.5 Publicly Available Information

As part of our intelligence and due diligence operations, we collect, aggregate, and process publicly available information from a wide variety of sources, including but not limited to: public websites, domain registration records, SSL certificate data, DNS records, trademark databases, corporate filings, court records, social media profiles, marketplace listings, advertising libraries, and other public sources. This information is collected at census scale as part of our Constellation Data.

#### 2.6 Information from Third-Party Sources

We may receive information from third-party data providers, including technology detection services, search API providers, web scanning services, and other data vendors. We may combine this information with other information we collect.

### 3. HOW WE USE YOUR INFORMATION

#### 3.1 Service Provision

We use your information to provide, maintain, and improve Daypart Products, including generating Reports, running predictions, maintaining the Constellation Data, and delivering intelligence outputs.

#### 3.2 Model Training and Improvement

We use User Data, including claims, verdicts, and feedback, to train, validate, improve, and develop our predictive models, detection algorithms, and intelligence capabilities. This includes incorporating aggregated, de-identified derivatives of User Data into our Constellation Data, which is used in the provision of services to other users. We do not use identifiable end-user personal information (such as names, email addresses, or contact details of your individual customers or end users) for model training; model training uses entity-level, behavioral, and pattern data.

#### 3.3 Analytics and Research

We use aggregated and de-identified data to conduct research, generate trend analyses, produce public dashboards and market intelligence reports, and develop new products and features.

#### 3.4 Marketing and Communications

We may use your contact information to send you service-related communications, marketing materials, and promotional content. You may opt out of marketing communications at any time.

#### 3.5 Advertising

We use the advertising and marketing technologies described in Section 2.4 to measure advertising effectiveness, retarget visitors, build audience segments, and optimize our marketing efforts. Information collected through these technologies may be shared with the advertising platforms listed in Section 2.4.

#### 3.6 Security and Fraud Prevention

We use information to detect, prevent, and respond to fraud, security incidents, and violations of our Terms of Service.

#### 3.7 Legal Compliance and Law Enforcement Cooperation

We may use and disclose information as we believe necessary to: (a) comply with applicable law, regulation, or legal process; (b) respond to requests from law enforcement, regulatory agencies, or government bodies; (c) enforce our Terms of Service; (d) protect the rights, property, or safety of Daypart, our users, or the public; or (e) support investigations, enforcement actions, or legal proceedings, including but not limited to cooperation with the Securities and Exchange Commission, the Federal Bureau of Investigation, the Federal Trade Commission, U.S. Customs and Border Protection, and any other governmental or regulatory agency.

### 4. DATA SHARING AND DISCLOSURE

#### 4.1 No Sale of Personal Data

Daypart does not sell personal data about individual persons to third parties. Our products are intelligence and analytics outputs, not raw personal data.

#### 4.2 Aggregated and De-Identified Data

We may share aggregated, anonymized, or de-identified data that cannot reasonably be used to identify any individual. Such data may be incorporated into the Constellation Data and used without restriction, including in the provision of services to other users and in public-facing dashboards and reports.

#### 4.3 Service Providers

We share information with third-party service providers who perform services on our behalf, including cloud hosting providers, payment processors, analytics providers, and communication platforms. These providers are contractually obligated to use your information only for the purposes of providing services to us.

#### 4.4 Advertising Partners

As described in Section 2.4, we share information with advertising and marketing platforms, including Meta, Google, X.com, and LinkedIn (Microsoft), through tracking technologies implemented on our Products. This sharing enables measurement, retargeting, and optimization of our advertising.

#### 4.5 Legal Obligations and Law Enforcement

We may disclose information if required to do so by law or in good faith belief that such action is necessary to comply with legal obligations, respond to legal process, cooperate with law enforcement or government agencies, protect our rights or property, or protect the safety of our users or the public.

#### 4.6 Business Transfers

In the event of a merger, acquisition, reorganization, bankruptcy, or other business transaction, your information may be transferred as part of that transaction.

#### 4.7 With Your Consent

We may share your information for purposes not described in this Privacy Policy with your explicit consent.

### 5. DATA RETENTION

#### 5.1 Account Data

We retain account information for as long as your account is active and for a reasonable period thereafter to fulfill legal obligations, resolve disputes, and enforce our Terms.

#### 5.2 Constellation Data

Constellation Data, including aggregated, de-identified derivatives of User Data, entity records, relationship graphs, predictions, and citations, is retained indefinitely. This data forms the persistent knowledge graph that is core to Daypart's intelligence capabilities. Nothing in the Constellation Data is ever deleted; all records are append-only with full historical audit trails. This retention is necessary for the integrity of our intelligence products, legal defensibility, and the continuous improvement of our models.

#### 5.3 Legal and Investigative Data

Data related to legal proceedings, investigations, regulatory inquiries, or enforcement actions may be retained indefinitely as required for legal purposes.

### 6. YOUR RIGHTS AND CHOICES

#### 6.1 Access and Correction

You may access and update your account information at any time by logging into your account or contacting us at privacy@daypart.com.

#### 6.2 Deletion Requests

You may request deletion of your personal account information by contacting us at privacy@daypart.com. Please note that deletion requests are subject to the following exceptions: (a) data that has been aggregated, de-identified, or incorporated into the Constellation Data is no longer personal information and is not subject to deletion; (b) data that must be retained for legal compliance, ongoing investigations, or law enforcement cooperation; (c) data necessary for the establishment, exercise, or defense of legal claims; and (d) data retained pursuant to Daypart's immutability and audit trail principles, where the data has been de-identified.

#### 6.3 Cookie Preferences

You can control cookies through your browser settings. Please note that disabling cookies may affect the functionality of our Products.

#### 6.4 Marketing Opt-Out

You may opt out of marketing communications by following the unsubscribe instructions in any marketing email or by contacting us at privacy@daypart.com.

#### 6.5 Do Not Track

Our Products do not currently respond to "Do Not Track" browser signals.

#### 6.6 California Residents (CCPA/CPRA)

If you are a California resident, you have additional rights under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (collectively, "CCPA"). These include the right to know what personal information we collect, the right to delete personal information (subject to the exceptions in Section 6.2), the right to opt out of the sale or sharing of personal information, and the right to non-discrimination. #### 6.7 Other State Privacy Laws

Residents of states with applicable privacy laws (including but not limited to Virginia, Colorado, Connecticut, Utah, and Texas) may have additional rights. To exercise any applicable rights, contact us at privacy@daypart.com.

### 7. DATA SECURITY

We implement reasonable administrative, technical, and physical safeguards designed to protect information from unauthorized access, use, alteration, and destruction. However, no method of transmission over the Internet or electronic storage is completely secure, and we cannot guarantee absolute security.

### 8. CHILDREN'S PRIVACY

Daypart Products are not directed to individuals under the age of 18. We do not knowingly collect personal information from children. If we become aware that we have collected personal information from a child, we will take steps to delete such information.

### 9. INTERNATIONAL USERS

Daypart is based in the United States and processes data in the United States. If you access Daypart Products from outside the United States, you consent to the transfer and processing of your information in the United States, which may not provide the same level of data protection as your home country.

### 10. INTELLIGENCE AND INVESTIGATION ACTIVITIES

#### 10.1 Nature of Our Services

Daypart operates as an intelligence and analytics platform that collects and processes publicly available information at scale. Our services involve the collection, aggregation, analysis, and reporting of information about companies, products, brands, marketplaces, and related entities. This activity is fundamentally different from the sale of personal data.

#### 10.2 Publicly Available Information

The majority of information processed by Daypart is publicly available and is collected from sources that make such information freely accessible on the Internet. We process this information to generate intelligence outputs and analytical products. Our collection and processing of publicly available information is consistent with the expectations of individuals and entities that publish information publicly.

#### 10.3 Distinction from Data Brokerage

Daypart does not operate as a data broker. We do not sell, license, or trade lists of personal information about identified individuals. Our products are intelligence reports, analytical assessments, and predictive outputs: processed intelligence, not raw data. Information about individuals that may appear in the Constellation Data exists in the context of entity relationships, corporate structures, and investigative intelligence, not as a consumer data product.

### 11. CHANGES TO THIS PRIVACY POLICY

We may update this Privacy Policy from time to time. We will notify you of material changes by posting the updated Privacy Policy on our website and updating the "Effective Date" above. Your continued use of any Daypart Product after the effective date of any change constitutes your acceptance of the updated Privacy Policy.
